Individual User Subscriptions are provided to all who register
on PowerCating.com. Subscribers to this service are granted permission to post
content on various electronic communication functions throughout the site. All
subscribers are subject to the terms of use contained herein. Registration to
this forum is free! Registration only takes a few seconds of your time. We do
insist that you abide by the rules and policies detailed below. If you are
under 13 years old, you need to provide parental consent in writing.
Although the administrators and moderators of PowerCating.com will attempt to
keep all objectionable messages off this forum, it is impossible for us to
review all messages. All messages express the views of the author.
PowerCating.com will not be held responsible for the content of any message or
for any loss suffered from the use of this site or its services. Guests and
members use this site at their own risk.
Without limitation, the Subscribing Individual agrees that it and its Members
will use the Services and the Site only in accordance with these Terms, and
will not use them to:
a. upload, store, post, link to, email or otherwise transmit, distribute,
publish or disseminate any Virtual Site Content, Content or other information
(i) that is unlawful, harmful, threatening, abusive, harassing, tortuous,
defamatory, vulgar, obscene, pornographic, objectionable or libelous, or
promotes such activity; (ii) that (or the transmission, distribution,
publication or dissemination of which) infringes any patent, trademark, trade
secret, copyright, or other rights or proprietary rights of any party, violates
any contractual or fiduciary relationships (such as inside, proprietary or
confidential information); (iii) that is harmful to minors; or (iv) that
contains software viruses, trojan horses, worms, time bombs, cancelbots or any
other computer code, files or programs designed to interrupt, destroy or limit
the functionality of any computer software or hardware or telecommunications
equipment or circumvent any "copy-protect" devices, any other harmful or
disruptive program, or any warez, cracks, hacks, associated utilities or other
piracy related information;
b. provide inaccurate, incomplete, outdated or misleading Registration
Information or e-mail addresses, create a false identity or manipulate
identifiers to mislead or to disguise the origin of any information stored on
the Site or transmitted through the Services, or impersonate or otherwise
misrepresent any affiliation with any person or entity;
c. modify, use, download, publish, upload, post, transmit, transfer, sell,
reproduce, create new or derivative works from, license, distribute, perform,
display, broadcast, exploit or otherwise copy any portion of the Services, Site
Name, or any Content, or any products or other services (including software)
obtained therefrom, or permit access to the same by any unauthorized person or
entity;
d. interfere with or disrupt any links or click-through URLs provided through
the Services, or servers or networks connected to the Services, or violate the
regulations, policies or procedures of such servers or networks, or interfere
with another Subscribing Individual/Organization's or Member's use and
enjoyment of the Services;
e. attempt to gain unauthorized access to the Services, Content, other Sites,
Registration Information, Virtual Site Content or Personal Information, or
other computer systems, servers or networks connected to the Services; or
f. violate (intentionally or unintentionally ) any applicable local, state,
national or international law or regulation, including, but not limited to,
regulations promulgated by the U.S. Securities and Exchange Commission, any
rules of any securities exchange of any jurisdiction, laws regarding the
transmission through the Services of technical data or software exported from
the United States and/or the country(ies) in which the Subscribing Individuals
and/or its Members reside, and laws and regulations regarding online conduct
and acceptable content of the Subscribing Individual's transmissions and
postings.
If PowerCating.com discovers a violation of these Terms of Service, the
subscription may be terminated.
PowerCating.com does not monitor information transmitted through the Services
or use thereof except to the limited extent permitted in these Terms or the
Privacy Statement http://www.PowerCating.com/privacy, but we have the right
(but not the obligation) to delete, move or edit and to require the Subscribing
Individuals content to delete, move or edit any Registration, Site or Personal
Information that violates the same. PowerCating.com reserves the right to
examine the information within any posting, however, for the sole purpose of
determining if a violation of these Terms of Service has occurred. The
Subscribing Individual must evaluate and bear all risks associated with use of
the site and any other information or products obtained from the Services,
including any reliance on the accuracy, completeness or usefulness thereof.
The subscribing user agrees to the following Subscriber Rules:
.: Forum Rule 1 - No "Flaming"
1.1 You will not post any messages that harass, insult, belittle,
threaten or flame another member or guest.
1.2 You may discuss another member's
beliefs but there will be no personal (ad hominem) attacks on the member
himself or herself.
1.3 You will not misquote another member regardless of
context.
.: Forum Rule 2 - No "Trolling"
2.1 You will not post anything that disrupts the peace and harmony of this forum. a.
This includes deliberately reposting a post, thread, image or anything else
that has been removed by a staff member for a breach of forum rule.
2.2 You will not post anything that puts down or belittles any group or denomination.
2.3 You will not enter inaccurate details in your profile to gain access to
restricted forums.
2.4 You will not use additional accounts to bypass a
suspension or ban from the forums. a. Banned or suspended members may still use
the Formal Appeals Process (See Rule 7.1).
2.5 You will not stalk and harass other members (including sexual harassment and unwanted attention).
.: Forum Rule 3 - No "Spamming"
3.1 You will not post any messages anywhere on this site that are primarily for the
promotion or advertising of any website, email address, business, MLM (Multi
Level Marketing or pyramid schemes).
3.2 You will not request, beg or solicit donations or financial support (charitable or otherwise, for any reason)
anywhere on the site including in e-mails, posts, and PMs.
3.3 You will not post any personal contact details in the forums. This includes email addresses,
phone numbers, and addresses.
3.4 You will not have external links, website addresses, domain names or email addresses in your signature, avatar, or custom
user title. You may post such links or addresses in your profile as long as
they abide by the rest of the forum rules.
3.5 You will not mass PM or email multiple members of this website with the same message.
3.6 You will not make useless posts to increase your post count.
.: Forum Rule 4 - No "Offensive" or "Illegal" Posts, PMs, Links, or Images
4.1 You will not post, attach, use or
send any posts, PMs, links, images or files: a. that are obscene, vulgar, or
sexually explicit (including any descriptions of sexual organs or activities in
any detail). b. that are hateful, racist, or sexist (discussions regarding
certain biblical interpretations on the roles of men and women will not be
considered "sexist" under this rule). c. that violate or promote the violation
of local or international laws and regulations (including the posting of any
copyright material such as songs, movies or text).
4.3 You will not bypass the automatic word censor in any way. In addition, if any word you
posted is automatically censored you will remove this word and use an
alternative.
.: Forum Rule 5 - No Promotion of Other Boating Forums
5.1 You will not post, attach, use or send any posts, PMs,
links, images or files that promote another boating forum.
.: Forum Rule 6 - Miscellaneous
6.1 You will not post about a specific staff member (or staff members) or about the
specific actions of a staff member (or staff members) in a public forum.
6.2 You will not post or use any part of this site or its services if you are 12
years old or younger in compliance with US law (known as COPPA law) until we
have received written approval from your parents.
6.3 You will ensure that you keep up to date with the most current version of the Forum Rules. We reserve
the right to vary, modify, add, substract or delete any of the Forum Rules or
part thereof at any time with or without notice.
6.4 You will be subject to the
Forum Rules at all times as Guests and Members of this site. This includes and
is not limited to Registered Members, Site Supporters (or Donating/ Supporting
Members), and all categories of Staff Members. b. This includes certain
forum-specific rules (that merely extends the current forum rules) which only
applies to certain controversial forums.
6.5 You will be reminded that donations are not compulsory, are given voluntarily by members, and by
definition are non-refundable under any circumstances.
6.6 You will be reminded that PowerCating.com is a private website. Although the staff of
PowerCating.com are expected to use the Forum Rules when moderating,
PowerCating.com reserve the right to remove, edit, move or close any post,
thread or member account for any other reason with or without notice.
6.7 You will not hold PowerCating.com, its owners, its staff members, or its members,
responsible for any losses or damages suffered as a consequence of using this
site or its services, or resulting from the actions or inaction of its owners,
staff members or members.
